Judge rules against Constellation

A Baltimore Circuit Court judge Thursday dismissed Constellation Energy's challenge to the state Public Service Commission's ruling that it has the right to stop Constellation's plan to sell a nearly half interest in its nuclear power plants to a French company.
Judge Stuart R. Berger said that Constellation, parent company of Baltimore Gas and Electric, may seek the court's review of whether the PSC exceeded its authority when the PSC renders its final decision.
Constellation contends that its proposed deal with Electricite de France, the largely government-owned operator of all 58 nuclear power reactors in France, met a "safe harbor" provision, exempting it from commission approval.
