Lanham homebuilder’s registration suspended by stateThe registration of Lanham homebuilder Derek A. McDaniels, the subject of numerous complaints and lawsuits by consumers and subcontractors, has been suspended by the state. McDaniels, owner of McDaniels Homes, was cited by the state’s Consumer Protection Division of the Attorney General’s Office for accepting deposits and payments from at least 13 consumers in Prince George’s and Charles counties and then failing to either begin or complete construction of the homes, pay subcontractors, or refund deposits and advance payments made by consumers. The company also failed to disclose to the division’s Home Builder Registration Unit lawsuits filed by consumers and subcontractors concerning the company’s building activities. McDaniels has built homes in Mitchellville, Bowie, Easton and Calvert County. Buyers’ complaints included faulty construction such as leaks, cracked drywall and a cracked driveway. ‘‘Our wedding and honeymoon were perfection at its best. Unfortunately, the process of building our dream house became and continues to be a nightmare,” Roman Yasinsky, who bought a Calvert County home from McDaniels, told The Gazette last year. Efforts to reach McDaniels for comment by press time were unsuccessful. A hearing is scheduled for Aug. 25. The Home Builder Registration Unit is seeking injunctive relief, restitution, damages and civil penalties against McDaniels, according to a statement from the Consumer Protection Division. ‘‘The law in Maryland is very clear: Homebuilders must honor their commitments to home buyers and properly use their deposits and payments,” Attorney General Douglas F. Gansler (D) said in a statement issued Tuesday. ‘‘My office will seek severe sanctions against builders who fail to properly handle consumer deposits and who do not operate their businesses fairly and honestly.” Consumers who have had problems with McDaniels or other builders may contact the Home Builder Registration Unit at 877-259-4525 or homebuilder@oag.state.md.us.
