Elementary teacher indicted on child sex abuse charges

A physical education teacher at Gaithersburg Elementary School was indicted Friday on several charges stemming from the alleged sexual abuse of a juvenile.

Tina Walker, of Montgomery Village, is facing three criminal counts, including sexual abuse of a minor and being an accessory after the fact. The charges carry a combined possible penalty of 23 years in jail. Her trial is scheduled for May.

The Gazette is not identifying the victim, who was not a student at Gaithersburg Elementary.

Walker was placed on leave from her job by Montgomery County Public Schools.

‘‘She is on leave with pay, pending results of the Office of Human Resources investigation and the court’s disposition,” said MCPS spokeswoman Kate Harrison.

Walker’s charges are related to a 20-year-old registered sex offender, Randall J. Fleming, who was also indicted Friday for sexual abuse of a minor and two counts of fourth-degree sex offense.

According to charging documents, Fleming had been out of jail less than two months on a previous charge of second-degree rape before committing the offenses both he and Walker were indicted in connection with last week.

In the earlier case, Fleming admitted to having sex more than 10 times over the course of about a year with an 11-year-old girl from his Montgomery Village neighborhood.

He was arrested in November 2006 and pleaded guilty in March 2007. In May, Circuit Court Judge Paul H. Weinstein sentenced him to four years in jail, suspending all but 16 months. With credit for time served, the 16 months would have been up this month, but he was released from jail early.
