Apartment complex plan hearing postponed

The fate of a 20-acre parcel of land in Eldersburg still hangs in limbo after a long-awaited hearingwas postponed Thursday. Carroll County Circuit Court Judge Michael M. Galloway will bring the case back into court on Friday, Feb. 18, at 1 p.m.

Security Development Corporation, which has planned a 254-unit apartment complex for the site located off of Liberty Road and backing to Kali Drive, wants members of the county's Planning Commission and Carroll County Commissioner Julia W. Gouge jailed for contempt of court.

In August, the Planning Commission denied approval of the developer's plans despite a 1999 court order by retired Judge Luke Burns.

Inadequate water facilities, schools and roads were the major factors keeping the development from beginning construction.

Last week's hearing is another chapter in the nearly 10-year fight over the land.

The developer's original site plan was presented in 1995.

Several residents of surrounding neighborhoods and Carrolltowne Elementary School Principal Martin Tierney filled the courtroom to show their opposition to the residential development of the property.

As of Feb. 2, residents in the area collected more than 780 signatures from people who also oppose the site plan.

At that Feb. 18 hearing, Galloway could decide to dismiss the case.

He said his decision would not be announced at that time but in a written document later this month.
