![]() THE GAZETTE HEALTHY CHALLENGE COMPETITION 2007 MONTGOMERY COUNTY OFFICIAL RULES NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN THIS PROGRAM. 1. Registration Period/Deadlines. The Gazette Healthy Challenge Program ("Program") begins on March 7, 2007 at 5 p.m. Eastern Time (ET) and ends on March 21, 2007, 11:59 p.m. ET. All entries must be received by 11:59 p.m. ET, on March 21, 2007. Interviews will be held with prospective contestants and will occur on or about March 28, 2007, at The Gazette, 9030 Comprint Court, Gaithersburg, MD 20877. Final selection of ten (10) contestants to compete in the challenge will be based on application, essay and interview. Final contestants will be notified on or about March 30. 2. Entry Forms - Internet Only. There are two ways to enter the Program: The Internet Method and the Mail-In Method. Internet Method: To enter this program, access The Gazette Web site located at www.gazette.net and click on the Healthy Challenge link in the upper righthand corner. Complete and submit the entry form, by following the entry instructions, during the registration period. Entrants understand that they are subject to The Gazette's Terms of Use and Privacy Policy for its Web site. Limit of one (1) Program entry per person. Multiple entry forms from the same person will be destroyed. Entrants that submit more than one entry form may be disqualified. All entries become the property of The Gazette and will not be acknowledged or returned. 3. Eligibility Requirements. This program is open only to legal residents of Montgomery County, MD, who are 18 years of age or older as of date of entry and who meet and comply with the requirements below. To be eligible to enter this program, entrants must be overweight or obese, as defined by the Centers for Disease Control and Prevention (CDC) as having a body mass index (BMI) of 25 or greater. BMI is calculated by dividing a person's weight (in pounds) by the person's height (in inches) squared then multiplying the total by 703. For example, a 5-feet 9-inch person weighing 175 pounds would calculate their BMI as follows: 175 (pounds) divided by 4,761 (69 x 69 inches) = .037. Then multiply .037 by 703. The total equals 26. Thus, the BMI for this person is 26 and this person is eligible to enter the program. To calculate your BMI as defined by the CDC, visit the CDC's Web site located at http://www.cdc.gov/nccdphp/dnpa/bmi/calc-bmi.htm. 4. Physical Activity Involved. Entrants should understand that some prizes will involve physical activity, and entrants are urged to consult with their own doctor to verify they are able to receive the prizes and perform physical activities associated with such prizes. All final contestants will be required to sign a waiver before beginning the Challenge releasing The Gazette and all of the program prize providers ("Sponsors") from liability in the event of injury and/or death of the contestant or any other person(s) or damage to property in conjunction with any activities relating to this program. 5. Team Selection: Two teams of five (5) contestants each will be selected by The Gazette from the ten (10) contestants chosen by The Gazette:
6. Healthy Challenge Program. In order to win the Team Prize, and Grand Prize designated for a particular contestant, that contestant must actively participate in and substantially complete the applicable Healthy Challenge program below: A. For the Up County contestants of Initial Prize Package: 1. April - June 2007 the Program contestant must participate in the Healthy Challenge program by (a) attending one (1) health screening provided by Montgomery General Hospital in beginning of the program and one (1) health screening provided by Montgomery General Hospital at the end of competition; (b) participating in the personal training program given at and designed by Sport & Health, consisting of approximately a 45-minute exercise training session three (3) times per week; (c) continuing to exercise at home with starter kit provided by Fitness Resource, (d) having a skin treatment at Aroma MedSpa, (e) participating in group tennis lessons given by Aspen Hill Club, (f) attending weekly meeting at a local Weight Watchers location; (g) redeeming gift certificate from Whole Foods Market at one of its Montgomery County locations; (h) participating in yoga program classes provided by Thrive Yoga. 2. The Program contestant must continue to participate in the Healthy Challenge by (a) accepting hair/styling services from XP Art Salon (b) participating in group dance lessons given by Arthur Murray Dance Studios; (c) attending a class schedule consultation and campus tour with Montgomery College, (d) and attending financial education sessions with Mid Atlantic Federal Credit Union.B. For the Down County contestants of Initial Prize Package: 1. April - June 2007 the Program contestant must participate in the Healthy Challenge program by (a) attending one (1) health screening provided by Suburban Hospital in the beginning of the competition, and one (1) health screening provided by Suburban Hospital at the end of the competition ; (b) participating in the personal training program given at and designed by Fitness First, consisting of approximately a 45-minute exercise session three (3) times per week; (c) continuing to exercise at home on start kit provided by Fitness Resource, (d) having a skin treatment at Atlantis MedSpa, (e) participating in group tennis lessons given by Aspen Hill Club, (f) attending weekly meeting at Weight Watchers location in Montgomery County; (g) redeeming gift certificate from Whole Foods Market at one of its Montgomery County locations; (h) participating in Yoga program given by 9210 Yoga. 2. The Program contestant The Program contestant must continue to participate in the Healthy Challenge by (a) accepting hair/styling services at KOHRA Salon (b) participating in group dance lessons given by Arthur Murray Dance Studios; (c) attending a class schedule consultation and campus tour with Montgomery College, (d) and attending financial education sessions with Mid Atlantic Federal Credit Union.C. April- June 2007 - All ten (10) program contestants MUST participate in two Healthy Challenge events by attending:1. Kick Off Event - Location TBD - in early April, 2007 2. Live Final Weigh-In with Healthy Challenge Fashion Show on June 20, 2007. Location to be announced. D. April- June 2007 - All ten (10) program contestants must participate in the Healthy Challenge by competing in weekly Thursday evening weigh-ins at their assigned health clubs and participate in all four team challenges: 1) Dance Off Challenge - Arthur Murray - April 20072) Cook Off Challenge - Montgomery College - May 12, 2007 3) Sports Challenge - Tennis at The Aspen Hill Club - May 21, 2007 4) Outdoor Challenge - Montgomery County Department of Recreation - June 9, 2007 E. Team and Individual Grand Prizes- Two teams of five will compete to lose the most % of body weight from April 4th to June 20th 2007. The teams will weigh in on Thursday evenings and will win team points by winning weigh-ins and challenges throughout the program. The winning team and overall individual winner will be decided at a June 20, 2007 finale weigh-in event. Click here for Grand Prizes7. Substitute Contestant(s). All prizes will be awarded provided the contestants actively participate in and complete the Healthy Challenge Program 1 or Program 2 as applicable. Should any initial Program contestant decline to accept any one or more of the Initial Program prizes, the contestant will be required to sign a release and may, at the sole discretion of The Gazette, be eliminated from the contest at any point during the contest and ineligible to receive any or all future prizes. Should any initial Program contestant decline to actively participate in or substantially fail to complete his/her applicable Healthy Challenge Program's requirements listed in rule six (6) above, he/she will (i) forfeit any and all unclaimed or unused initial prizes, (ii) forfeit the chance to win the applicable Grand Prize, and The Gazette may select another person who originally entered the contest by the entry deadline to partcipate in the remainder of the Healthy Challenge. That substitute contestant then becomes eligible (subject to these Official Rules) for the remainder of the prizes not already claimed or used by the initial Program contestant. The substitute contestant agrees to be bound by and is subject to all these Official Rules. 8. Contestants' Responsibilities. Contestants are solely responsible for the reporting and payment of any tax liabilities incurred. Any expenses relating to the receipt of these prizes, including but not limited to expenses for travel and doctor visits and any medical treatment outside the scope of prizes listed in the Official Rules are solely the responsibility of the contestants. 9. . Ineligible Persons. The Program is not open to (a) employees of The Washington Post Co. or its affiliates, licensees, parents, subsidiaries, divisions, dealerships, advertising and promotion agencies, or members of the immediate family or members of the household thereof, or (b) employees of the Sponsors or their respective affiliates, licensees, parents, subsidiaries, divisions, dealerships, advertising and promotion agencies, or members of the immediate family or household of each. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. 10. General Conditions. This Program is subject to all applicable federal, state and local laws. Void outside Montgomery County, MD. By participating, entrants agree to be bound by these Official Rules and the sole and absolute decisions of The Gazette, and waive any right to claim ambiguity in the Program or these Official Rules. By participating, each Program contestant and entrant also releases, discharges, indemnifies and holds harmless The Gazette, its parent companies, and the Sponsors and each of their respective owners, managers, officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Program-related activity or participation in this Program. In order to receive the prizes in the Program, the contestant is not required to purchase any goods or services, pay any money or submit to any sales promotion effort. Contestants may be required to sign additional waivers and releases in order to receive prizes. 11. Contestants' Consent. Except where prohibited: (i) acceptance of the initial prize constitutes consent to use each Program contestant's name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, without further compensation; (ii) each contestant may be required to sign an affidavit of eligibility and liability/publicity release; and (iii) The Gazette and/the Sponsors may share the information submitted on the entry forms with their affiliates and customers. Each Program contestant understands and agrees that writers, under contract with The Gazette, and Gazette photographers and/or photographers under contract with The Gazette, will follow each contestant's progress for at least 13 weeks while contestants participate in the Healthy Challenge Program, including being present with Program contestant(s) at any event during which the Program contestants receive initial prizes or Grand Prizes. Each Program contestant understands and agrees that The Gazette intends to publish, both in print and online (via the Internet), updates on the progress of each Program contestant throughout the 13 week Healthy Challenge Program. Such updates may include photographs and/or references to each contestant by name, including personal information about each contestant as it relates to receipt of prizes. Failure to permit The Gazette to publish the contestant's information and/or picture will automatically disqualify that contestant, who will forfeit all unclaimed and unused prizes and The Gazette will choose a substitute contestant (who will be subject to all of these Official Rules). 12. Contestant's Name. For the names of the contestants, send a self-addressed stamped envelope after April 4, 2007, to: The Gazette, 9030 Comprint Court, Gaithersburg, MD 20877, Attn.: Kim Showman. The Sponsor/Promoter of this Program is The Gazette in partnership with its Sponsors. 15. Limitations of Liability. The Gazette is not responsible and assumes no responsibility for late, lost, misdirected, undeliverable or incomplete entries, whether online or otherwise, due to postal errors, system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or online entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, or faulty transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, or entries not received by The Gazette on account of technical problems or traffic congestion on the Internet, or at a Web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from entering the Program or downloading any material for the Program, or other telecommunications malfunctions which may limit an entrant's ability to participate. The Gazette may prohibit an entrant from participating in the Program or winning a prize if, in its sole discretion, it determines that said entrant is (i) attempting to undermine the legitimate operation of the Program by cheating, hacking, deception, or other unfair playing practices or (ii) intending to annoy, abuse, threaten or harass any other entrants or The Gazette representatives. IN NO EVENT WILL THE GAZETTE BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, INDIRECT, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES) ARISING OUT OF THIS PROGRAM.
